English

Objective: The purpose of this research is to examine the current legal order governing the protection of journalists' personal data in the Islamic Republic of Iran, with a focus on the Constitution and two ordinary laws, namely the DAVAM (Electronic Commerce) Law and the Computer Crimes Law.
Method: This research is based on the library method and on the analysis of legal texts, with a focus on the Constitution of the Islamic Republic of Iran and the two laws of DAVAM and Computer Crimes. It also draws upon secondary sources such as legal works related to media law, computer crimes, and personal data protection. The analytical method is grounded in the main foundations of descriptive and explanatory analysis, as well as literal interpretive analysis.
Results: The findings of this study indicate that the principles encompassing the role, status, and privacy protection of journalists are regarded as appropriate for a democratic society, and that, as a consequence of such a role and status, the protection of journalists' personal data should be distinct from that of ordinary citizens. However, journalists' personal data is protected under two ordinary laws, like that of other individuals; in other words, there is no specific and clear law in this regard.
Conclusions: The status of journalists in a democratic society is distinct from that of other individuals, and even their lives and personal data are indirectly linked to the principles of media rights and, in short, to the architecture of freedom of expression. Failure to guarantee this in the cyberspace of artificial intelligence-integrated structures can play a destructive role in the personal lives of journalists and negatively affect their media activities.
